Withdrawal from the contract

After receipt of the order, the Consumer has the right to withdraw from the contract concluded in the e-shop without giving any reason within 14 days. The 14-day right of withdrawal does not apply if the consumer has opened an item delivered in a closed package that is not suitable for return for health or hygiene reasons or if the products or services are not returnable by their nature within the meaning of Section 53 (4) of the LOA (e.g. underwear, bras, swimwear and sunbathing suits, socks, open-packaged cosmetics, perfumes, toiletries, blankets and pillows).

The right of withdrawal does not apply if the buyer is a legal person.

In the case of deterioration of the goods to be returned, the consumer is liable for the loss of value resulting from the use of the goods only if he has used the goods in a way other than that necessary to ascertain their nature, characteristics and functioning. In order to ascertain the nature, characteristics and functioning of the goods, the consumer should handle and use them only as he would normally be allowed to do in a shop. (For example, it may be possible to try on clothes in a shop, but the labels must not be removed from the clothes, and the clothes must not be soiled, damaged or tainted by perfume, smoke or any other extraneous odour). Therefore, it cannot be excluded that the value of the product has been reduced to zero as a result of the damage and K&N OÜ is entitled to claim compensation for the reduction in value. The transport costs of the deteriorated goods shall be borne by the Consumer.

The consumer must either return the goods within 14 days of the request or provide proof that he has handed them over to the logistics company within the aforementioned period. The cost of returning the goods is borne by the buyer, unless the reason for returning the goods is that the goods to be returned do not correspond to those ordered (e.g. wrong or defective goods).

K&N OÜ shall, upon receipt of the notice of withdrawal, refund to the Consumer without undue delay, but not later than 14 days after receipt of the notice of withdrawal, all fees received from the Consumer under the Contract. K&N OÜ shall have the right to delay the refund until the Consumer has returned the Product or provided proof that the Consumer has returned the Product.

If the buyer has expressly chosen a delivery method other than the cheapest delivery method offered by the Online Shop, the Online Shop is not obliged to reimburse the consumer for the cost that exceeds the cost of the usual delivery method.
